Terms & Conditions

Welcome to MDU Resources Group, Inc. Surplus Website (“MDUR Surplus”). By registering to use the MDUR Surplus service, you accept and agree to the terms and conditions of this User Agreement, or you may not access or otherwise use this service or auction site.

This User Agreement may be updated by MDUR Surplus at any time. The amended User Agreement will be posted on the site and use of the site and its services shall evidence your acceptance of and agreement with the amended terms thereof. Acceptance of the User Agreement requires you to abide by all rules, terms and conditions of the MDUR Surplus site. If you decline to abide by the terms and conditions set forth within this User Agreement, you will forfeit your right to use the MDUR Surplus auction site.

Eligibility and Registration
MDUR Surplus auction is open to anyone.  While using MDUR Surplus, you agree that you will not:
     • violate any laws, third party rights, or our policies
     • use the MDUR Surplus auction site if you are unable to enter into a legally binding contract, are under the age of 18, or prohibited from the use of the site    
     • fail to deliver payment for items previously purchased by you
     • manipulate the price of any item
     • collect information about users, including email addresses, without their consent

 

Termination
MDUR Surplus reserves the right, in its sole discretion, to refuse use of its site to anyone at any time for any reason without prior notice or explanation.

Fees and Services
Bidding on MDUR Surplus is free. Bidders must honor all successful bids placed in any auction and are obligated to complete the transaction with MDUR Surplus or the respective Seller. The winning bid is defined as the highest bidder in a regular auction. By placing a bid during the auction, the bidder agrees to honor all listed terms of such sale including, but not limited to, method of payment, appropriate sales tax, and freight. Failure to honor this obligation may result in termination of the user registration.

Payment Terms
The successful bidder will submit payment in full, plus any applicable fees or taxes, within 10 days of the auction end. Seller reserves the right, at any time, to remove or refuse sale of any merchandise on the MDUR Surplus website. All transactions must be in the form of certified funds to include, certified bank check, cashier’s check or money order.

No cash, credit cards, personal checks or corporate checks accepted.

Shipping
Buyer is responsible for all shipping charges associated with winning bid. Buyer must coordinate pick up of item(s) within 30 days of auction end, unless Seller has agreed to other terms.

 

Warranty
Seller makes no representation, warranty, or covenant regarding the presence of any defects or the condition, state of repair, maintenance, or functionality of the assets.  The seller expressly disclaims all warranties, whether statutory, express or implied, that may be applicable to the assets including without limitation, the warranty of merchantability, fitness for a particular purpose, suitability, and warranties arising from course of dealing.  The assets are being conveyed to the Buyer "AS IS" "WHERE IS" and "WITH ALL FAULTS."

Indemnification
Buyers agrees to indemnify, defend, hold harmless, and release MDUR Surplus, MDU Resources Group, Inc., its subsidiaries, divisions, employees, agents, officers and directors from and against all claims and liabilities resulting from other users’ actions or inactions, including things they post and the same shall be held harmless for any damages arising out of the use, the misuse, or the inability to use, the site and services.  The seller has afforded the buyer the opportunity for full and complete investigations, examinations and inspections of the assets.  Buyer assumes all risk and liability whatsoever resulting from buyer's possession, use or disposition of the assets.

Release
Buyers agree to release MDUR Surplus, MDU Resources Group, Inc., its subsidiaries, divisions, employees, agents, officers and directors who are not a party to the specific transaction from any liability of any nature whatsoever should a dispute arise between the parties to a transaction.
